Gerard Depardieu caught allegedly driving drunk

PARIS (AP) ? French actor Gerard Depardieu was detained Thursday for allegedly driving drunk on his scooter, police said.

The 63-year-old actor, who has appeared in more than 150 films, was brought in to a Paris police station Thursday afternoon, an official with the Paris police department said.

The Paris prosecutor's office ordered him detained, the official said. She spoke on condition of anonymity because she was not authorized to discuss ongoing investigations.

The burly actor was picked up off after he fell off his scooter in northwest Paris, the Sipa news agency reported. He failed a sobriety test and was taken to a police station, according to Sipa.

A call to Depardieu's management company was not returned Thursday night.

Thursday's incident was one of several encounters with the law for Depardieu. He grabbed headlines when he urinated in the aisle of a plane before takeoff on a Paris to Dublin flight. He was removed from the aircraft.

In 1998, he crashed his motorcycle when his blood-alcohol limit was five times over the legal level, escaping with leg and face injuries.

Depardieu, a bon vivant who overcame a speech impediment and a childhood of neglect to become one of France's most popular and versatile film stars, was nominated for an Academy Award for his role in the 1990 film "Cyrano de Bergerac."

Judge: UK needs independent press regulator

LONDON (AP) ? Britain's unruly newspapers should be regulated by an independent body dominated by non-journalists with the power to levy steep fines for ethical lapses, a judge recommended Thursday after a yearlong inquiry.

But Prime Minister David Cameron immediately expressed deep misgivings about a key recommendation in the 2,000-page report ? that the new regulator be enshrined in law. Cameron said he was concerned about government interference in free speech.

"I'm proud of the fact that we've managed to survive hundreds of years without state regulation," he said.

The impasse left questions about the eventual impact of Lord Justice Brian Leveson's sweeping probe of media ethics in Britain. The inquiry was triggered by a tabloid phone hacking scandal that expanded to engulf senior figures in politics, the police and Rupert Murdoch's media empire.

The report pleased victims of tabloid intrusion but left editors worrying about creeping state control of the country's fiercely independent press.

Leveson's key recommendation was to create a new regulator for newspapers and their websites, which he said should be established in law to prevent more people from being hurt by the "outrageous" press behavior that had "wreaked havoc with the lives of innocent people."

"The ball moves back into the politicians' court: They must now decide who guards the guardians," he said.

Cameron, under intense pressure over an issue that has divided his own Conservative Party, welcomed Leveson's proposal for a new regulator, saying "the status quo is not an option."

But the prime minister said asking legislators to enshrine it in law meant "crossing the Rubicon of writing elements of press regulation into the law of the land."

"I believe that we should be wary of any legislation that has the potential to infringe free speech and a free press," Cameron told lawmakers in the House of Commons. "We should think very, very carefully before crossing this line."

Cameron instead called on the much-criticized British press to show it could control itself by implementing the judge's proposals quickly without political involvement.

Leveson insisted that politicians and the government should play no role in regulating the press, which should be done by a new body with much stronger powers than the current Press Complaints Commission.

He said the new body should be composed of members of the public including former journalists and academics ? but no more than one serving editor and no politicians. It should have the power to rule on complaints, demand prominent corrections in newspapers and to levy fines of up to 1 million pounds ($1.6 million), though it would have no power to prevent material from being published.

Membership would be voluntary, but newspapers would join in part to stave off expensive lawsuits ? the regulator would handle complaints that now end up in court.

The proposal is similar to the system operating in Ireland, where a press council and ombudsman were set up in 2008 to make the print media more accountable.

Critics of the tabloid press generally backed Leveson's findings.

"I welcome Lord Leveson's report and hope it will mark the start of a new era for our press in which it treats those in the news responsibly, with care and consideration," said Kate McCann, who was the subject of intense press interest after her 3-year-old daughter Madeleine disappeared during a 2007 holiday in Portugal.

Brian Cathcart of the group Hacked Off, which campaigns for victims of press intrusion, said Leveson had produced "a workable, proportionate and reasonable solution to the problems of press abuse."

Cathcart called Cameron's inability to accept its recommendations "unfortunate and regrettable."

Cameron set up the Leveson inquiry after revelations of illegal eavesdropping by Rupert Murdoch's now-defunct News of the World tabloid sparked a criminal investigation and a wave of public revulsion.

The furor erupted in 2011 when it was revealed that the News of the World had eavesdropped on the mobile phone voicemails of slain schoolgirl Milly Dowler while police were searching for the 13-year-old.

Murdoch shut down the 168-year-old newspaper in July 2011. His U.K. newspaper company, News International, has paid millions in damages to dozens of hacking victims, and faces dozens more lawsuits from celebrities, politicians, athletes and crime victims whose voicemails were hacked in the paper's quest for scoops.

News International chief executive Tom Mockridge said the company was "keen to play our full part, with others in our industry, in creating a new body that commands the confidence of the public."

"We believe that this can be achieved without statutory regulation ? and welcome the prime minister's rejection of that proposal," he added.

Leveson's 4-million-pound ($6.4- million) inquiry heard evidence from more than 300 witnesses over months of dramatic, sometimes comic and often poignant testimony. Witnesses ranged from celebrities such as Harry Potter author J.K. Rowling and actor Hugh Grant ? who both complained of intrusive treatment ? to the parents of Dowler, who described how learning that their daughter's voicemail had been accessed had given them false hope that she was alive.

Leveson said the ongoing criminal investigation constrained him from accusing other newspapers of illegal behavior, but concluded there was a subculture of unethical behavior.

While many editors have denied knowing about phone hacking, Leveson said it "was far more than a covert, secret activity, known to nobody save one or two practitioners of the 'dark arts.'"

He said newspapers had been guilty of "recklessness in prioritizing sensational stories almost irrespective of the harm the stories may cause."

The hacking scandal has rocked Britain's press, political and police establishments, who were seen to enjoy an often-cozy relationship in which drinks, dinners and sometimes money were traded for influence and information.

Several senior police officers resigned over the failure aggressively to pursue a 2007 investigation into phone hacking at the News of the World. But Leveson said "the inquiry has not unearthed extensive evidence of police corruption."

Leveson said over the past three decades, political parties "have had or developed too close a relationship with the press in a way which has not been in the public interest."

Those relationships reached right up to the prime minister's door. Former Murdoch editors and journalists charged with phone hacking, police bribery or other wrongdoing include Cameron's former spokesman, Andy Coulson, and ex-News of the World editor Rebekah Brooks, a friend of the prime minister.

Still, Leveson acquitted senior politicians of wrongdoing.

Cameron was holding talks Thursday with leaders of the other main parties in an attempt to thrash out some agreement on press regulation.

He faced a battle. His own deputy prime minister, Nick Clegg, the leader of his coalition partner the Liberal Democrats, differed from Cameron in backing the call for a new regulator established in law.

"We owe it to the victims of these scandals, who have already waited too long for us to do the right thing," Clegg said.

Duties & Responsibilities
Harvard School of Engineering and Applied Sciences (SEAS) seeks an experienced chief communications officer to provide leadership in all areas of communications. Having moved from a division to a school in 2007 the critical role SEAS plays in the education of our students has been highlighted and is a priority in the upcoming University campaign. The Executive Director of Communications will play a critical role in communicating the School's vision and strategic plan to key stakeholders as well as noteworthy news and events.

Reporting to the Executive Dean for Administration and serving on the Executive Management Team,?the Executive Director of Communications:

  • Oversees the external and internal communications activities of a school comprised of nearly 100 faculty, 1100 students, and 500 staff/researchers, and as such is the School's official public information officer.
  • Provides strategic leadership for communications as part of the School's development and alumni relations activities (including integration with leadership at the University level) and helps to direct branding and positioning for the forthcoming Harvard Capital Campaign.
  • Serves as a liaison to offices and departments throughout the school and University and, in particular, collaborates strategically with Harvard Public Affairs and Communications Office, the Faculty of Arts and Science, and other Harvard schools and institutes on communications priorities for the University (such as innovation, translational research & development, sustainability, and global impact) and ensures the proper representation of the school in all high-level messaging.
  • Enables a platform for internal and external communications and marketing related activities for the School's functional areas, in particular Student Affairs (e.g. tours, recruitment videos, Visitas); Human Resources (e.g., internal e-letters, award support); Facilities (construction updates); Events (e.g., announcements, invitations, day-of-materials); and Finance (Annual Report).
  • In conjunction with the Executive Director of Computing, works to develop a sustainable web/digital communications strategy for the school and link such efforts to the University's digital endeavors.
  • Provides support for high-level, high-visibility events in collaboration with the Events Director and affiliated stakeholders.
  • Manages the Communications Office.
Basic Qualifications
A Bachelor's degree plus a minimum of 10 years' experience preferably in a university environment working with all aspects of communications including admissions, development, alumni relations, student advising and technology transfer. Experience translating science and engineering into lay-friendly language is essential as is experience ghost writing and speech writing. Supervisory experience. Experience with web technologies is also required.

Additional Qualifications
Master's degree in a related field preferred.

GOP divide surfaces early in 2014 Senate contest

WASHINGTON (AP) ? That didn't take long.

The fissures within the Republican Party that some say cost the GOP control of the Senate have resurfaced just three weeks after the election. This time conservatives are targeting a popular veteran congresswoman from a storied West Virginia political family making a bid for Democrat Jay Rockefeller's Senate seat in 2014.

Within an hour of Shelley Moore Capito's announcement of her candidacy, the influential and conservative Club for Growth branded her as the "establishment candidate" whose record in Congress of supporting prominent bailouts has led to bigger government. Capito just won her seventh term to Congress, securing about 70 percent of her district's vote. Her father, former Gov. Arch Moore, for years was the chief political rival of the man she hopes to replace in the Senate.

The new head of the Senate's GOP campaign arm, Sen. Jerry Moran of Kansas, dismissed the criticism from the right ? "I don't see this as damaging to her cause" ? but it's far from inconsequential in the Republicans' bid to retake the Senate.

Moran hasn't officially taken over as chairman of the National Republican Senatorial Committee yet, but he already finds himself defending a potential nominee who's widely popular in her state while trying to avoid alienating influential players on the party's right flank.

Downplaying the impact of the Club for Growth's criticism of Capito, Moran said Tuesday his committee hasn't made a decision on how heavily involved it will be in West Virginia's Republican Senate primary two years from now.

"Shelley Moore Capito is a known quantity in West Virginia," he said. "Her voting record is acceptable to the majority of West Virginians in her district for a long period of time. I don't see this as damaging to her cause."

Rockefeller, 75, has not said whether he'll seek a sixth term in the Senate, but Capito has the name recognition and fundraising ability to mount an effective campaign against an incumbent.

The Club for Growth wasted no time listing what it believes are her numerous faults. They likened her to candidates such as Rick Berg of North Dakota and Rep. Denny Rehberg of Montana, saying that while they were supposedly the most electable of the Republican candidates, they lost Senate races in Republican-leaning states.

"Her candidacy will undoubtedly be cheered by the GOP establishment, and dire warnings will be issued against any 'divisive' primary challenges, lest other candidates hurt Capito's chances of winning," said Club for Growth President Chris Chocola. "The problem is that Congresswoman Capito's record looks a whole lot like the establishment candidates who lost this year."

But many of the Club for Growth's candidates in recent elections also have stumbled badly. Richard Mourdock lost in Indiana after bouncing veteran Sen. Richard Lugar in the primary. In the 2010 elections, the organization threw its considerable financial backing behind Sharron Angle in Nevada and Ken Buck in Colorado, both losers to vulnerable Democratic incumbents.

Moran said the criticism of Capito from the Club for Growth was not unexpected.

"This is going to be decided not by the NRSC and not by the Club for Growth; it's going to be decided by the people of West Virginia," he said.

In the last election cycle, Democratic leaders in Washington didn't mind playing favorites during the primaries, heavily recruiting candidates they thought had the best chance of winning, while shunning some they did not see as formidable. GOP leaders, in contrast, sat back as their potential nominees fought it out.

Moran said figuring out the NRSC's role in the coming primaries will take a couple of months, and said his organization will play a role in some states.

"It's a state-by-state issue," he said.

Democratic officials, meanwhile, are enjoying the sideshow of a potential GOP split already in the works.

"Their argument is correct that the handpicked Republican establishment candidates did just as poorly as the more tea-party candidates," said Matt Canter, spokesman for the Democratic Senatorial Campaign Committee. "It's hard to argue with them in that respect."

Canter said the establishment candidates stumbled in part because of their efforts to appeal to tea party supporters and strong anti-government organizations such as the Club for Growth. He said an outsider might find it easy to defeat Capito, because GOP primaries in West Virginia typically do not attract a lot of voters.

"It would be very easy for a right-wing candidate to get the votes needed to win," Canter said.

Republican strategist Ron Bonjean said he would have preferred for the Club for Growth to have waited to see if a viable alternative to Capito emerges before attacking her. With Mitt Romney easily winning the state, Republicans figure to have a strong shot of winning the Senate seat in 2014.

"She's the best that state has to offer at this point," Bonjean said. "There's not a deep bench of Republican candidates who can immediately step into the fold, who can take on Sen. Rockefeller. Going after a female Republican right now when we lost the women's vote is not necessarily the wisest political move either."

Chocola said supporting fiscal conservatives such as Jeff Flake in Arizona and Ted Cruz in Texas, both Senate winners this month, is the best way back for the GOP.

"They are the future of the Republican Party," he said.

URBANA University of Illinois scientists have found a way to boost current industry capabilities when it comes to reducing the number of E. coli 0157:H7 cells that may live undetected on spinach leaves.

"By combining continuous ultrasound treatment with chlorine washing, we can reduce the total number of foodborne pathogenic bacteria by over 99.99 percent," said Hao Feng, a U of I professor of food science and human nutrition.

According to Feng, the USDA is looking for proposed technologies that can achieve a 4 to 6 log reduction in pathogen cells (a 6 log reduction would achieve a million-fold reduction in pathogenic bacteria). The food processing industry can now achieve a 1 log or tenfold reduction. In comparison, the U of I technique yields a 4 log reduction.

"Combining technologies is the key to bridging the gap between our current capacity and what USDA would like to see. The use of ultrasound exposure during chlorine washing gives the industry a way to significantly enhance microbial safety," he said.

Feng's pilot-scale system uses three pairs of large-area ultrasonic transducer boxes to form a channel through which ultrasound is provided to spinach leaves that are undergoing a continuous-flow chlorine wash. Spatial uniformity of ultrasound distribution was confirmed by tests using metallic foil.

The scientist said that continuous flow and uniformity of the field are key elements in the success of the process.

"Previous work with ultrasound used a tank or a medical-style probe, which doesn't provide consistent and even distribution," he noted.

System design is important for another reason, he said. "Placement of the produce as it makes its way through the channel turns out to be very important. We had to find ways to make sure that leaves received similar exposure to ultrasound, taking care to minimize the chance that one leaf would block a nearby leaf's exposure to the sound waves."

If even part of a leaf escaped the full ultrasonic treatment, it could contaminate the rest of the produce, he said.

Feng and his team have used the technique on iceberg and romaine lettuce as well as spinach with similar results.

Black Friday & Cyber Monday Sales DataThe weekend after Thanksgiving was one of the most aggressive marketing blitzes in recent memory. News reports had three shopping holidays to choose from: the venerable Black Friday, which started around 1961 but didn?t gain the influence it now has until as late as 2005; Small Business Saturday, a American Express-backed venture that took advantage of a Twitter hashtag in 2010 supporting local brick-and-mortars; and Cyber Monday, coined by the National Retail Federation in 2005. These three days have only been increasing in search volume and clout, and are now at the forefront of the holiday business season.

The IBM Reports

In today?s Big Data world, it?s easier than ever to analyze huge data sets and IBM was one of the first to get out a report on the buying weekend. Their Black Friday and Cyber Monday Reports are troves of information, giving website analytics data for e-commerce sites across a wide swath of industries. We were hipped to this data by Mashable, who curiously reported that Twitter yielded no revenue to these clients. It seems that despite massively ramped-up social advertising spending this year, leading BIA/Kelsey to project a 19.2% compound annual growth rate to 2016, social media sites only offered .34% of referrers on sales on Black Friday and .41% on Cyber Monday. Representing a loss in revenue of 35% and 24% respectively, it might seem that social was a dud.

However, between the three shopping days, over 447,000 people used the related hashtags, and millions more used less tech-savvy terms to talk about the events. Twitter, Facebook, and other social media sites have become utterly ubiquitous, combining with the adoption of social media by people who are wealthy enough to buy the majority of gifts for the holidays ? that is, parents. Was all that marketing a waste? Or was social media part of a wider sales strategy that led to an annual e-commerce sales growth of 20% on Black Friday and 30% on Cyber Monday?

Did View-Through Traffic Matter?

Black Friday & Cyber Monday Sales Data My immediate thought when looking at this data was that social media was being discounted, as it often is an intermediary step between product research and buying that product. Especially during sales, users will shop around, compare products, and come to the same retailer through a variety of advertising channels. Much like paid search and organic social media posts, the buying cycle can be particularly long, especially when all of your competitors are also vying for your customers.

But even clicks aren?t particularly valuable as a metric, as many saw these deals passively through advertisements and posts in their feed. Social media acts similarly to television ads, giving snippets of information to raise interest. This kind of passive brand-building is hard to track, but certainly affects users by letting them know that there?s a sale and they should check out the site for more deals, leading to businesses over-valuing direct rather than social media traffic. While this kind of analysis is difficult, businesses have to use impression-based attribution to track the ROI of social media.

The Power of Email

Also left out of IBM?s analysis is email. We?ve all seen our inboxes swell with bacn as the buying season approached, warning us of the deals to come on all the sites that have acquired our email at some point. Major retailers carpet-bombed our inboxes, leaving hundreds of subject lines for us to click or ignore. Many marketers champion email as a much more effective use of marketing spend that users prefer to social media advertising. Why did IBM choose to ignore the direct-mail campaigns in their study?

Astronauts to spend a year in orbit

Astronaut Scott Kelly will become the first U.S. astronaut to spend a year in space. Why? He is volunteering to be a human guinea pig -- to help NASA collect detailed medical and psychological data about the effects of long term spaceflight on a human. He and cosmonaut Mikhail Kornienko are scheduled to launch to the International Space Station in 2015 and return to Earth in 2016.

He was on the space station when his twin brother Mark was struggling to deal with the trauma of his wife's shooting. Mark Kelly, now retired from the astronaut corps, is a married to former Congresswoman Gabrielle Giffords ? and Scott could only offer long distance support to his twin brother when his wife was shot during in January 2011.

Jared Loughner has now pleaded guilty to 19 federal charges in the mass shooting that killed six and injured 13, including Giffords, who was hosting a congressional event that day.

Scott Kelly wished he could have done more to help. That is one of the drawbacks of a long term mission -- there is no easy way home if something happens to a loved one on Earth.

Kelly clearly understands the risks -- and the rewards -- of long-duration space flight. He is, after all, a Navy fighter pilot, used to assignments overseas. He told ABC News in an interview before his last mission to the space station that his research was important to the future of space travel.

Scott Kelly "We need to learn how people can live and work in space for long periods of time, also how the equipment can survive and operate for long periods," he said. "If we are ever going to send people to live on the Moon, we are three days away, or to live on Mars where you are potentially 18 months away, we need to have some very robust systems to allow them to survive there. And the only place you can learn how to build and operate those systems is on the space station."

We already know many of the risks -- NASA has documented the damage to the eyesight of seven astronauts after they returned from spending months in space. Their flight surgeons have gone on record discussing bone density loss, decreased muscle mass, and the psychological isolation.

Why would anyone volunteer for this? The International Space Station is after all, is the only game in town if you are an astronaut and a mission to the dark side to the moon, while a popular topic, isn't funded yet, and Mars? Still decades away.

When will the U.S. space program get back into flying NASA astronauts into space? Hopefully by 2017. Several companies are working to build and certify human rated spacecraft to take crew, and cargo to the International Space Station.

While NASA touts the medical research accumulated from a year in space, the reality is that this also frees up a couple of seats on the Russian Soyuz spacecraft to sell to tourists.

When the U.S. space shuttles quit flying last year, they created a conundrum for companies like Space Adventures, whose business -- sending rich tourists into space -- depended upon the resources of Roscosmos, the Russian Space Agency. Roscosmos is the only space agency willing to send tourists to space (NASA won't do it, and now they don't have a spacecraft anyway so it's a moot point). Singer Sarah Brightman announced she is buying one of the seats -- and then launched a concert tour, so time will tell if she is really serious about training for a flight.

Kelly is an experienced astronaut -- he served as pilot on space shuttle mission STS-103 in 1999, commanded STS-118 in 2007, was flight engineer on the International Space Station Expedition 25 in 2010 and commander of Expedition 26 in 2011.

Kelly has logged more than 180 days in space, and a yearlong mission this would bring his total to almost 550 days. Impressive numbers, but the record will still belong to Russian cosmonaut Sergei Krikalev, who, over six missions, spent 803 days, 9 hours and 39 minutes of his life in space.

Football leads NBC to ratings win

(AP) ? Two football games that showed the widely divergent paths of New York's pro football teams boosted NBC to its first ratings win of the new season.

NBC aired the Jets' embarrassing loss to the New England Patriots on Thanksgiving night, and followed it on Sunday with the Giants' easy victory over the Green Bay Packers.

Those two big prime-time audiences on a holiday week enabled NBC to win its first week in the Nielsen company's ratings since it televised the Super Bowl last winter.

Lifetime's debut of the movie "Liz & Dick" starring Lindsay Lohan reached 3.5 million viewers on Sunday, Nielsen said.

NBC averaged 9.5 million viewers in prime-time for the win (5.6 rating, 9 share). CBS was second with an 8.3 million average (5.2, 9), ABC had 8.2 million (5.0, 8), Fox had 6.2 million (3.6, 6) and the CW and ION Television both had 1.2 million (both 0.8, 1).

Among the Spanish-language networks, Univision led with a 3.4 million viewer average (1.7, 3). Telemundo had 1.2 million (0.6, 1), TeleFutura had 800,000 (0.4, 1), Estrella had 240,000 and Azteca 110,000 (both 0.1, 0).

NBC's "Nightly News" topped the evening newscasts with an average of 10.2 million viewers (6.8, 12). ABC's "World News" was second with 8.3 million (5.5, 11), and the "CBS Evening News" had 7.1 million viewers (4.8, 8).

A ratings point represents 1,147,000 households, or 1 percent of the nation's estimated 114.7 million TV homes. The share is the percentage of in-use televisions tuned to a given show.

For the week of Nov. 19-25, the top 10 shows, their networks and viewerships were: NFL Football: Green Bay at N.Y. Giants, NBC, 20.85 million; NFL Football: New England at N.Y. Jets, NBC, 19.21 million; "NCIS," CBS, 16.48 million; College Football: Notre Dame at USC, ABC, 16.06 million; "NCIS: Los Angeles," CBS, 15.13 million; "Dancing With the Stars," ABC, 14.28 million; "The OT," Fox, 13.5 million; "Dancing With the Stars Results," ABC, 13.01 million; "Football Night in America," NBC, 12.8 million; "Criminal Minds," CBS, 11.53 million.

the New School: Who Owns the Cascadian Dark Ale?


Though the battle lines are still drawn, the field of battle has been rather quiet in the Black IPA vs. Cascadian Dark Ale debate. So, leave it to a small brewery in Vancouver, BC to stir controversy by staking its flag firmly into "Cascadia" as its own trademark. Never mind that Cascadia refers to a region that comprises Oregon, Washington, and parts of Canada and Idaho, or the fact that breweries have now been using the term for years. The resulting legal battle could be much more than an argument over style definitions; it would cross borders into trademark laws and even ask the question of whether a style of beer, like so many other famous alcoholic beverages, can become specifically and legally associated with a specific region.


Steamworks Brewing, a popular brewpub in Vancouver, says it owns the term "Cascadia," as it was trademarked in 1996 after the brewery established a brand around its "Cascadia Cream Ale," which has not even been produced in years. Chuck Mowat, a Canadian beer blogger, broke the news on his Barley Mowat?blog that Steamworks recently began quietly contacting BC breweries warning them of their trademark infringement.

A recent spat of legal wars in the brewing industry over trademarks like the Full Sail vs Grey Sail dispute and current trouble brewing between Lagunitas and Knee Deep Brewing has left beer fans with a bad taste in their mouths. Defending a trademark is a necessary step in business that many do not understand. To keep from getting ripped off and not losing one's trademark, it must be defended. Where it goes sour is when the power granted from said trademark is wielded with an unjust hand. A recent example is the short-lived Willamette Brewing, which was renamed as Oakshire Brewing due to the trademark of a winery using the name "Willamette," notwithstanding the fact that both companies were located near their namesake river. Speaking of Oakshire, that brewery was the first in Oregon to package a beer officially branded on the label as a Cascadian Dark Ale, so maybe someone from Oakshire will chime in on this subject.

You could say the term "Cascadian Dark Ale" has always smacked of provincialism, as it is a term that could be construed as being attributable to the egos of the?style's purported creators in the?Cascadian region. Others may argue that it's not fair for such a small area to claim an emerging style. To this I say, why not, there are styles for "Flanders" Red, "Dortmunder" Lager, Czech Pilsners, and the like. One brewery claiming lordship over all things "Cascadia," however, seems to be the ultimate elitist regionalism there could be. Over at the Barley Mowat blog, Chuck Mowat riled up enough Canadians to get angry about the issue that Steamworks owner Eli Gershkovitch finally issued a response over the weekend to quell the masses. To me what he had to say made it even worse:

"The concept of Cascadia was pretty novel in 1995, that?s why we chose it! I guess if a whole group of people want to use a name we came up with in 1995 because we were farsighted about the concept of Cascadia, we should be flattered."

Now, let's be clear, Steamworks Brewing did not come up with the concept of Cascadia. Maybe it was the first to use the term on a beer, but it certainly did not come up with the concept of the region. In fact, the beer brand in question has apparently not been brewed for years and was never packaged. However, if you go to Steamworks' website, the brewery now seems to have renamed its Nirvana Brown Ale simply as "Cascadia" in a feeble grab to keep the name and trademark alive.

"We thought our Cascadia should not just be a name but a full brand...we built up a brand image around our idealized image of Cascadia...we hired a designer, used the imagery in artwork, printed hundreds of thousands of coasters and created a brand which fitted in really well in our brewpub," writes Eli Gershkovitch in his response to the controversy. All I can say to that is, where is this imagery? The artwork I see shows a hot air balloon lifting up the top of a clocktower into the sky and is far more reminiscent of Victorian culture than anything fitting of Cascadia.

Eli Gershkovitch has offered to license the term?for a fair price?to breweries he sees fit?"to preserve the integrity of the name "Cascadia" for true craft breweries not for large multinational breweries to homogenize or lay claim to the name. Our plan is to license the trademark to other true B.C. craft breweries for a very nominal fee ($1 perhaps), which is legally needed to protect the trademark for all." Of course this sounds generous, but it's also absurdly unrealistic. As Chuck Mowat says in his blog, he would happily cut Steamworks a check for the $56 needed to license the term to all the breweries in BC. The more likely situation is that Steamworks is going to play hardball with the term. In fact, the brewery apparently already has, with sources telling me Vancouver brewer Parallel 49 had to change its Christmas Cascadian Dark Ale to Christmas Dark Ale, and Phillips Brewing--arguably the brewer of the original CDA--settling out of court to preserve its "Skookum Cascadian Brown Ale," a beer that has been brewed for years and is even packaged in bottles with the name "Cascadian."?


All this bullshit makes me wonder where Americans stand on this issue. Steamworks has the Canadian trademark, but it doesn't carry over to the United States; in fact, there's a Steamworks Brewing Company in Durango, CO. But what if a CDA is distributed to Canada, like Gigantic Brewing's recently released Black Friday Cascadian Dark Ale has been? We have seen this happen with other segments of the beverage industry: as the industry gets bigger, producers get regulated further regarding where products are made and what processes are involved, to a point where most cannot legally produce a style of alcohol if not in the right place. Take, for instance, American Bourbon Whiskey, which is restricted in production to a small area of Kentucky by Title 27 of the U.S. Code of Federal Regulations; tequila, which is an exclusive product of certain regions of Mexico; or champagne, which must come from the Champagne region of France. Imagine a future where Cascadian Dark Ale was a product exclusively of Vancouver, BC, or, hopefully, of the entire Cascadia region. Would this be a good or bad thing?

Regardless, it is complete arrogance on the part of Steamworks to presume that it could own the term of an entire region's independence movement that ironically calls for "a dedication to open source, dynamic, and associative governing models, an expansion of civil liberties, freedoms, digital privacy."

What is the value of a business owner having a relationship with an accountant?

As business owners, we often build our own mental barriers to change, until something changes?

When I first met this one client, every time we talked, he would bring up his desire to offer health insurance to his employees. I would ask him about talking to his insurance agent, and he would present me the options that were presented by the agent. He had? ?trust? in his agent, and was somehow looking for me to resolve ?the problem?.

I would suggest talking to another insurance agent, but would get resistance. After about 6 months of this, I finally told the client that EVERY time we had talked , this subject had come up, and it was time to put or shut up. I told him that if his insurance agent was so good, then we wouldn?t be having this conversation every single month, that at least, it was worth talking to another agent.

He met with a different?insurance agent, and a whole different solution was presented with my client now offering health insurance to all his employees with a minimal match by him as the employer.

My point is that, to my client, that problem that could have festered for a lot longer. But it was because he had a ?relationship? with an accountant or business adviser, he was able to get out of his mental box and move on.

As a business owner, don?t settle for just looking for a bookkeeper or an accountant. Look for a someone that you feel comfortable with, someone that?s approachable. Look for someone that you feel comfortable opening up to.

If you can?t open up, then your advisory can?t help you get out of your box and help you achieve your long term objectives. With that all said, you also have to give the relationship time, and not expect results within days of starting this relationship.

Doubting Readiness for Marriage | Ask the Therapist

I?ve been dating my boyfriend for 6 months, during the first month we talked about marriage. I have been married before at 19 for only 3 months and I thought I was over it and didnt care. Now that I?m seeing my boyfriend and the thought of marriage came up I developed a generalized anxiety disorder and have been dealing with it. He is so good to me and sticks by my side no matter what but lately I?ve been having doubts if he is the one for me, or if I?m ready for marriage and basically just panicked.

I cant seem to just go with the flow of the relationship, it?s like I need an answer now. Also we are long distance and have yet to spend more than 4 days at a time together. I feel maybe if we got engaged the doubts would go away but if they didn?t this would only cause him more hurt. Im completely honest with him and only want the best for both of us, I just don?t want to regret leaving someone I love just because of doubts. I can?t think of a better guy, I could be more attracted to him but looks aren?t important to me but I also want to be able to love him back the way he deserves and not feel this pressure to move on to marriage or either move on to someone else, I just want to see where it goes but my head it constantly telling me I need to leave him or that I love him and he is amazing and great and that he is the one for me.

A: Listen to your instincts. They are good. Talking about marriage in the first month of dating and pursuing the issue when you?ve never had more than 4 days together makes no sense at all. Of course you?re anxious. What?s the rush? I don?t think the problem is that you?re ?gun shy? from a short marriage 7 years ago. I think your system is trying to slow you down.

I?m also concerned that you aren?t more attracted to him. Yes, he may be wonderful. But attraction does matter. It shouldn?t be the only factor in your decision but it certainly should be considered.

I think you should take a big step back. Put the marriage question on hold until you?ve had some quality and quantity time together. Give yourself time to get to know how you two click when you aren?t in ?visit? mode. You need some time to get into daily routines and see how it works. If your boyfriend pressures you to move faster, there?s something amiss. A decision as important as who you?ll spend the rest of your life with deserves time and attention. If he truly loves you, he can slow down too.

There?s a sweetness to the time of courtship. It?s a time to explore each other on many, many levels. It?s a time to learn everything from what kind of toast a person prefers to how to please each other physically. It?s a time to enjoy being the full focus of someone else?s love and attention. It?s a time to meet each other?s family and friends to see if there?s a good fit. It?s a time to talk about the endless possibilities that go into making a life together, from your personal goals to your hopes and dreams for a life together. Don?t shortchange yourselves. Enjoy the romance.

Shredded Police Documents Found At Macy's 2012 Thanksgiving Day Parade

Attendees at Macy's Thanksgiving Day Parade on Thursday were alarmed to discover something unusual littered among the usual multicolored confetti: confidential police documents, shredded but still legible.

WPIX reports that the documents belonged to New York's Nassau County Police Department. Among the information gleaned from the shreds of paper were "social security numbers and banking information for police employees, some of whom are undercover officers." Mentions of Mitt Romney's motorcade -- probably a reference to Romney's appearance at Hofstra University for a presidential debate in October -- were also visible.

The would-be confetti was found by Ethan Finklestein, a college student and New York native, who described the discovery to WPIX:

"It landed on [a friend's] shoulder," Finkelstein told PIX11 News, "and it says 'SSN' and it's written like a social security number, and we're like, 'That's really bizarre.'

It made the Tufts University freshman concerned, so he and his friends picked up more of the confetti that had fallen around them.

"There are phone numbers, addresses, more social security numbers, license plate numbers and then we find all these incident reports from police."

One confetti strip indicates that it's from an arrest record, and other strips offer more detail. "This is really shocking," Finkelstein said. "It says, 'At 4:30 A.M. a pipe bomb was thrown at a house in the Kings Grant' area."

The documents were shredded horizontally, rather than vertically -- "one of the least secure methods," Newsday points out -- which allowed entire lines of text to be easily read.

Macy's has denied that it was the source of the confetti, stating in an interview with WPIX that it's official confetti materials are punched-out pieces, rather than shreds, of colorful paper. Gawker, meanwhile, speculates that the shredded documents "could've come out of any of the countless number of office windows along the 6th Avenue parade route."

A representative for Nassau County Police told WPIX that the Department was "very concerned about this situation. We will be conducting an investigation into this matter as well as reviewing our procedures for the disposing of sensitive documents."

As Newsday notes, the Department "did not address who shreds sensitive police documents, who carts them away, or the progress, if any, of the investigation so far."

A bill before the Ohio Senate could thoroughly revamp how employees file complaints about workplace discrimination and harassment?and greatly benefit employers that have robust anti-discrimination and harassment policies and practices. Senate Bill 383 is a generally pro-employer piece of legislation that will probably draw union opposition.

If enacted?not a sure thing?the bill would require an employee complaining of discrimination or harassment to choose between filing an administrative charge with the Ohio Civil Rights Commission or filing a complaint in court. Currently em??ployees may do both.

Either way, employees would have to file their complaints within one year of the alleged discriminatory act.

Noneconomic and punitive damages on all discrimination suits would be capped, depending on the employer?s size:

  • 4 to 100 employees: $50,000
  • 101 to 200: $100,000
  • 201 to 500: $200,000
  • More than 500: $300,000.

The bill would also sharply curtail individual liability, limiting it to employers, not individuals.

An employer could raise an affirmative defense to discrimination or harassment claims by showing it exercised reasonable care to prevent or promptly correct unlawful discriminatory or harassing behavior. It could do so by demonstrating a reasonable anti-discrimination and anti-harassment policy that includes a complaint procedure, and that the accusing employee unreasonably failed to take advantage of it.

To capitalize on that safe harbor, the employer would have to show that it took specific actions to:

  • Publish its anti-discrimination/anti-harassment policy
  • Inform employees of prohibited conduct and how to complain ?
  • Acted upon internal complaints in a reasonable and prompt manner.

Note: It?s not clear whether S.B. 383 has enough legislative support to become law. Organized labor is likely to fight its passage.

Advice: Regardless of whether S.B. 383 becomes law, you should implement anti-discrimination and anti-retaliation policies that provide employees with reasonable ways to file complaints. Give them at least two avenues for filing harassment complaints.

Institute procedures for thoroughly investigating harassment and discrimination complaints. Have your attorney regularly review your policies and procedures.

In a previous article, we took a look at the first two stages of ovarian cancer. We can now turn our attention to the last two.

In stage III, the cancer is becoming more advanced as in addition to being in one or both ovaries, the cancer has spread past the pelvis to the abdominal lining and may have also spread to the nearby lymph nodes. Stage III is also divided into IIIA, B, and C.

In stage IIIA, cancer cells are present in small amounts in parts of the abdomen as well as one or both ovaries.

In stage IIIB, cancer cells are also present in amounts less than two centimeters (three-fourths of an inch) in parts of the abdomen.

In the final subsection of stage III, IIIC, ovarian cancer has either spread to the nearby lymph nodes or cancer cells are present in amounts greater than two centimeters (three-fourths of an inch) in parts of the abdomen.

The last and most advanced stage of ovarian cancer that I would like to discuss is stage IV. In this stage, the cancerous cells?are present in one or both ovaries and have spread to other organs in the body, such as the liver or lungs.

These are the main stages of ovarian cancer. It should be noted that there can be one final stage and that is where the cancer is recurrent. This is when the cancer comes back in one of the organs of the body after it has already been treated.

Supreme Court To Consider Workplace Harassment Rules

Nov 23 (Reuters) - The U.S. Supreme Court on Monday will hear arguments in a case that could determine when a company is liable for harassment by its employees.
The case turns on the definition of a single word - "supervisor" - under a federal civil rights law that prohibits racial, religious or sexual harassment in the workplace.
Under previous Supreme Court rulings, an employer is automatically responsible if a supervisor harasses a subordinate. The employer is not liable if the harassment is between two equal coworkers, unless it was negligent in allowing the abuse.
Since those rulings, a rift has developed between federal appeals courts over exactly who is a supervisor. On one side, three circuits say supervisors are those with the power to hire, fire, demote, promote or discipline. Three other circuits have adopted a broader standard, one that also includes employees who direct and oversee a colleague's daily work.
In the current case, Maetta Vance was the sole black catering worker at Ball State University in Muncie, Indiana. After filing numerous complaints with the university over racially charged incidents at work, she sued the university in federal court in 2006. She claimed that several white coworkers used racial epithets, references to the Ku Klux Klan and veiled physical threats against her.
In trying to hold Ball State liable, Vance's lawyers argued that one coworker, Saundra Davis, was a supervisor because she had the power to direct her day-to-day activities. Davis did not have to record her time, like other hourly employees, Vance argued. But the district court dismissed the case before a trial, finding Davis lacked sufficient authority over Vance. It also found that Ball State had taken corrective action and had not acted negligently.
The 7th U.S. Circuit Court of Appeals, in Chicago, reached the same conclusion, reasoning that Davis did not have the power to change Vance's employment status, and therefore the university was not liable for Davis's conduct.
Vance petitioned the Supreme Court.
Before deciding whether to hear the case, the Supreme Court asked the Justice Department for the government's position, as it does in some cases. U.S. Solicitor General Donald Verrilli agreed with Vance that the 7th Circuit's narrow interpretation was wrong, but also argued that this wasn't the best case to decide the issue, given what it saw as weak facts that Davis was Vance's supervisor. Vance presented no evidence of tasks or instructions Davis gave her and even said she was uncertain whether Davis was her supervisor, the government's brief said.
The Supreme Court accepted the case anyway.
Ball State has made the same argument as the government. Davis "would fail to qualify as Ms. Vance's supervisor even under the broader interpretation of that term applied by certain courts of appeals," university spokesman Tony Proudfoot said in an email, citing the Solicitor General's brief.
But Daniel Ortiz, a lawyer for Vance, said that under the broader standard there is evidence Davis was a supervisor.
Davis, who Vance believed was her supervisor, "taunted her with racial epithets, slapped her at one point and made her life a living hell," Ortiz said.
Business groups, including the U.S. Chamber of Commerce and the National Federation of Independent Business, have filed briefs supporting the narrow definition of supervisor used by the 7th, 1st and 8th Circuits.
Adopting the narrower definition allows employers to easily identify employees who would trigger automatic liability so they can be screened, trained and monitored, the business groups argue.
The open-ended definition, used by the 2nd, 4th and 9th Circuits, offers little guidance or incentive to undertake prevention efforts, the U.S. Chamber said in its brief.
Camille Olson, a lawyer at Seyfarth Shaw who represents companies, said if the Supreme Court adopts the more expansive definition, employers will be potentially liable for the conduct of a much larger pool of employees.
"The expanded definition of whose conduct binds the employer will significantly increase litigation for employers," said Olson, who is not involved in the latest case. Employees may also have less incentive to report harassment promptly and to get any immediate issues fixed, opting instead for litigation, she said.
The broad definition of supervisor would also conflict with a narrower one used in the Fair Labor Standards Act and National Labor Relations Act, creating confusion, she added.
On the other side, plaintiffs' lawyers say the stricter standard ignores the practical reality of the workplace and allows discrimination and harassment to go unpunished.
"The ones most likely to engage in harassment are the ones who deal with their coworkers day-to-day but may not have the special power to hire, fire, promote or demote," said Matthew Koski, an attorney with the National Employment Lawyers Association, a group for lawyers who represent workers.
Supervisors who make final employment decisions may be in a different office or a different state, he said.
